We may also collect information about your mobile device and an internet connection, including the device's unique identifier, operating system, mobile network information, and telephone number. This may include, for example, photographs, audio and video clips, personal contacts, and address book information. How We Use the Information We Collect from You: The information we collect is necessary to provide you with the Services. When you register for a membership and create an account, we collect user-entered and submitted Information to identify you, such as your name, phone number, and email address. We will also collect photos and other distinguishing information to complete your profile. We may also record and collect photographs and videos of your image and voice, and share them with members and non-members. Authorized employees and contractors may be permitted to access your personal information, but only to provide you with the services you require. As a Member of Gem Matchmaking, you permit Gem Matchmaking to share your profile photos, pre-recorded videos, and profile details with other Members and non-members as part of the matchmaking service.

Here are reasons we may also use, store, and disclose your personal Information: In response to a subpoena, court order, investigative demand, or request for cooperation by law enforcement, legal authorities, or government agencies; to enforce our Service Agreement or other policies; to defend ourselves against legal claims or exercise our legal rights; to prevent, investigate, or take action against illegal activity, fraud, suspected fraud, or violation of the Service Agreement; to defend our employees, our company, our safety, or our users; to comply with legal data retention obligations, including without limitation tax and accounting legal requirements and documents evidencing our compliance with applicable law; to support our customer care decisions, enforce our rights, and enable us to defend ourselves in the event of a claim, in anticipation of potential litigation, and for the establishment, exercise, or defense of legal claims; to prevent users who were banned or people who were found to be under the age of 21 from opening a new account; tn connection with the sale of our business, a merger, acquisition, consolidation, proprietary information sale, asset sale, or significant corporate transaction; in the event Gem Matchmaking files for bankruptcy.

When you choose to participate, you provide us with Information to process your entry and participation, as well as responses to our questions and feedback. Purchase Data: When you make a purchase, we retain the transaction details (e.g., the items purchased, transaction date, and price). The exact date depends on the payment method you choose. Customer Support Data: When you contact us, you provide information that may be necessary to address your inquiry. Other people may also submit queries or reports involving you. Finally, our moderation tools and teams can collect additional data for their investigations. Further, Gem Matchmaking considers safety, security, and privacy. If you were banned from another matchmaking or online dating service, your data may be shared with us to allow us to take necessary actions, including closing your account or preventing you from creating an account on our service. Where legally permitted, we can also receive Information about suspected or convicted bad actors from third parties to ensure our members’ safety and security. Third-Party Data: When you choose to share Information about other people with us (for example, if you use the contact details of someone you know for a given feature or submit a query or report involving a member), we process this data on your behalf to complete your request. Social Media Data: We ask Members to share their social media account handles (Facebook, Instagram, LinkedIn) as part of our members' approval and verification process. Usage Data: The service generates data about your activity, including how you use it (e.g., when you log in, features you’ve been using, and actions taken). We may also receive data about your interactions with our ads on third-party websites or apps. Technical Data: Using the service involves collecting data from and about the device(s) you use to access our service, including hardware and software information such as IP address, device ID and type, app settings and characteristics, app crashes, advertising IDs, and identifiers associated with cookies or other technologies that may uniquely identify a device or browser. ID Data: You may provide us with a copy of your government-issued identification to help us verify your identity.

How and why we use your data: We primarily process your data to provide you with our service and continually improve it over time. That includes connecting you with members who might make your heart skip a beat, personalizing your experience, and helping you make the most of our service.

The length of time we retain your data: We want the connections you make through our service to last forever. Still, we retain your data only as long as necessary for legitimate business purposes and as permitted by applicable law. You can close your account if you decide to stop using our service. We will automatically close your account if you remain inactive for a period of two years.

Gem Matchmaking’s liability from or arising out of this Policy or any breach thereof shall be, regardless of theory of liability or cause of action, limited to direct damages. It shall not exceed US$100.00 under any circumstances.

SMS Text Message Policy: To provide you with timely updates and personalized service, Gem Matchmaking may communicate with you via SMS text messaging. Please review the following guidelines regarding our SMS communications:

Purpose: SMS messages may include appointment reminders, match introductions, event invitations, service updates, and important notifications related to your matchmaking experience.

Frequency: We strive to keep messages relevant and concise. You can expect occasional texts, typically no more than three messages per week, depending on your level of engagement and the service package you select.

Opt-In & Consent: By providing your phone number, you consent to receive SMS messages from Gem Matchmaking. Standard messaging rates may apply depending on your mobile carrier.

Opt-Out: You may opt out of receiving SMS messages at any time by replying “STOP” to any message. After opting out, we will no longer send you texts; however, we will continue to communicate with you via email or phone as needed.

Privacy: Your phone number and any information shared via SMS will be kept confidential and used solely for service-related communications. We do not share your contact information with third parties without your explicit consent.
