Member Rules: You are not using our services for commercial purposes, such as promoting products or services to other Members.; You will not disclose Confidential Information to any Third Party (and you will take the utmost care to keep Confidential Information secure and protected and to ensure that you do not inadvertently disclose Confidential Information); You will not pretend to be any person or entity other than yourself, including falsifying your name and age.; You will not disclose information that you do not have the consent to disclose; You will not provide any false, misleading, or otherwise fraudulent information, including but not limited to your personally identifiable information, geographical residence, marital status, financial status, professional status, and any other information furnished by you as required to deliver the services to you. You will not provide us with any photograph or other material with copyrights that do not belong to you. You agree to give Gem Matchmaking feedback about your dating experiences and interactions with your Matches. You agree not to search for the phone number, email, photos, social media profiles, place of work, home address, and other members' contact information without the member's consent. You agree not to request or connect with other members on social media without permission from the member. You will disclose any information impacting or compromising Gem Matchmaking’s ability to provide you with the Services. You will not imply or state that Gem Matchmaking endorses any statements you make without our prior written consent.; You will not use the Services to promote, condone, endorse, distribute, or publish any material that solicits money, funds, or people; You will review and become familiar with the Safety Practices; You will not stalk, harass, annoy, intimidate, threaten, or otherwise engage in any unreasonable conduct toward any Member, Gem Matchmaking employee, representative, or contractor who is involved in providing the Services to you; You will not use the Services to transmit, upload, or distribute any electronic/computer viruses, spyware, adware, trojan horses, or anything else that might cause harm to other Members of the Services, Gem Matchmaking, the online community, or Gem Matchmaking systems; You will not use a robot, spider, manual/automatic processes, or devices to data-mine, data-crawl, scrape, or index the Service in any manner; You will not hack or interfere with the Service, servers, or connected networks; You will not modify the Services for your own personal or commercial purposes. This includes, but is not limited to, altering, adapting, licensing, sublicensing, or translating the Services. You also agree that you will not aid others in such activities; You will not share confidential information, such as, but not limited to, the name and photo of other members on Facebook dating groups, Are We Dating The Same Guy Facebook groups, and/or similar groups, pages, and posts on social media; You will not remove or alter, visually or not, any copyrights, trademarks, or proprietary marks and rights owned by us; You will not forge, manipulate, or plagiarize messages, communications, headers, or identifiers to make it seem like such content is from Gem Matchmaking or its Members when it is not; You will give 24-hour ’ notice if you must reschedule or cancel a date, a Discovery Meeting, or a wardrobe styling session; You will consistently stay in contact with your matchmaker. Consistent or repeated refusal of matches, problematic lack of availability, or poor behavior on a date or towards a Gem Matchmaking Matchmaker could immediately terminate your account.; You agree, to the extent permitted under applicable law, to indemnify, defend, and hold harmless Gem Matchmaking, our affiliates, and their and our respective officers, directors, agents, and employees from and against any complaints, demands, claims, damages, losses, costs, liabilities and expenses, including attorney’s fees, due to, arising out of, or relating in any way to your access to or use of our Services, or your breach of this Agreement.

Enforcement: All members must comply with the above rules and requirements. If you behave in a way that goes against Gem Matchmaking's Rules and values or otherwise acts in any way we believe to be potentially harmful to Gem Matchmaking or its members, we will conduct an investigation. If Gem Matchmaking determines, in its sole discretion, that you have breached any portion of the Rules above or of these Terms of Use or have otherwise demonstrated inappropriate conduct, Gem Matchmaking reserves the right to (a) warn you that you have violated the Terms of Use; (b) suspend or terminate your account or any subscriptions without refund; (c) notify and send Your Content to and fully cooperate with the proper law enforcement authorities for further action; and (d) pursue any other action which Gem Matchmaking, in its sole discretion, deems to be appropriate. If your services are terminated for the conduct described above or for violating any of the Rules outlined in this Section, you will forfeit unused Services and not be entitled to a refund.

Illegal and Unauthorized Use: You must register with the Service. You represent and warrant that: (1) all registration information you submit will be true, accurate, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary. You agree to keep your password confidential and will be responsible for all your account and password use. Once you've registered on the Service, the account you create is for your personal use only. You may not access or use the Service for any purpose other than the one for which it is made available. You may not authorize others to use your account or assign or otherwise transfer your account to any other person or entity.

You shall not engage in any Illegal and unauthorized use of the Service, including but not limited to: Collecting personal information, usernames, or email addresses of Users by electronic or other means to send unsolicited email, unauthorized embedding, unauthorized framing of, or linking to the Service. Systematically retrieve data or other content to create or compile, directly or indirectly, a collection, compilation, database, or directory without our written permission. Circumvent, disable, or otherwise interfere with security-related features of the Website or App, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Website or App and the Content contained therein. Trick, defraud, or mislead other Users and us, especially in any attempt to learn sensitive account information such as User passwords. Gem Matchmaking has the right to investigate and take appropriate legal action, including, without limitation, civil, criminal, and injunctive relief, or refer you to applicable law enforcement authorities if you have misused the Services, taken any actions in defiance of these Terms and Conditions of Service or the Privacy Policy or conducted actions that are fraudulent, abusive, harmful, unlawful, or illegal.

Your account security: We strongly recommend keeping all your user information, such as account IDs, passwords, and other sensitive information, secret and not disclosing such information to anyone else. You are responsible for keeping your password for the Service confidential. Should you disclose it to anyone else, we cannot be responsible for any use of this information or for using or distributing any of your information or data stored with the Gem Matchmaking Website if obtained via your account ID or password. You are responsible for all actions and activities under your username and password. Gem Matchmaking will not be held liable for any damage or loss arising from your inability to comply with this provision. To help keep your username and password secure and confidential, we recommend that you log out of your account at the end of each session, especially when on a public machine. If you feel that your username and password have been breached or that your account has been used unauthorizedly, you will immediately notify Gem Matchmaking. Gem Matchmaking has used reasonable efforts to put in place appropriate technical and organizational security measures to protect against the loss, misuse, and alteration of user data under our control. While we cannot guarantee that data loss, misuse, or alteration will not occur, we make diligent efforts to prevent such unfortunate occurrences. We will not permanently store your credit card or other payment information (if applicable) unless you knowingly consent to such storage and unless we have implemented appropriate PCI (payment card industry) compliant measures to do so. We rely on a third-party billing processor, Stripe, to process credit and debit card payments from subscribing Members. We do not receive or retain your card information. You must accept the third-party payment processor’s terms and conditions to process your payment. We do not have control over, nor are we responsible for, those terms and conditions or their privacy practices. Gem Matchmaking employees view profiles in our Database. A Gem Matchmaker will share other members' profiles, including photos and videos, for matchmaking purposes with other members. We do not disclose the phone number, email address, mailing address, social media, or other Member contact information. This transparency offers us the best success in matching our Members. Blind Matching is not something we promote, but we will honor the request from our Members should they choose it. (Please see our Privacy Policy for more details.)

Criminal Records Screening: Gem Matchmaking conducts criminal background checks on every member under every membership level. A third party will screen you for your criminal record. Their Screening does not constitute a background check under the Fair Credit Reporting Act. The criminal records Screening will include a review of criminal history, including but not limited to any history of sexual assault, violence, and theft. No more than seven years of history may be legally reported, depending on the state of residence.

In connection with the criminal background screenings, we provide the following statements: We exclude from participation as a member all persons identified as having been convicted of a misdemeanor or felony offense or adjudication that requires registration as a sex offender or an offense for which an affirmative finding of but not limited to theft, violent, and repetitive non-violent crimes. Although we strive to provide a safe environment, please be aware that criminal background checks are not foolproof; criminal background checks may give individuals a false sense of security; criminal background checks are not a perfect safety solution; criminals may circumvent even the most sophisticated search technology; not all criminal records are public in all states, and not all databases are up to date; only publicly available convictions are included in the criminal background check; and the criminal background check does not cover other types of convictions than convictions for offenses set forth above or any convictions from foreign countries.

You understand and agree that Gem Matchmaking utilizes a third party to conduct a screening of available public records on you for any criminal history (“criminal history screening”) or identity verification checks or to otherwise inquire into your background, you as defined below. All other criminal record screenings will be performed at Gem Matchmaking’s discretion. GEM MATCHMAKING MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE CONDUCT, IDENTITY, INTENTIONS, LEGITIMACY, OR VERACITY OF GEM MATCHMAKING’S USERS OR THE INFORMATION USERS PROVIDE TO GEM MATCHMAKING; HOWEVER, WE RESERVE THE RIGHT TO CONDUCT—AND YOU AT THIS MOMENT AUTHORIZE US TO CONDUCT—ANY CRIMINAL OR OTHER SCREENINGS (SUCH AS MISDEMEANOR, FELONY, AND SEX OFFENDER REGISTER SEARCHES) ON YOU AT ANY TIME USING AVAILABLE PUBLIC RECORDS. YOU AGREE THAT ANY INFORMATION YOU PROVIDE MAY BE USED FOR THAT PURPOSE. SUPPOSE WE DECIDE TO CONDUCT ANY SCREENING THROUGH A CONSUMER REPORTING AGENCY. IN THAT CASE, YOU, AT THIS MOMENT, AUTHORIZE US TO OBTAIN AND USE A CONSUMER REPORT ABOUT YOU TO DETERMINE YOUR ELIGIBILITY UNDER THESE TERMS. GEM MATCHMAKING RESERVES THE RIGHT TO TERMINATE THIS AGREEMENT AND YOUR ACCOUNT WITHOUT REFUND IF ANY SCREENING WE CONDUCT ON YOU SHOWS THAT YOU ARE NOT ELIGIBLE FOR THE SERVICES OR ARE NOT IN COMPLIANCE WITH THESE TERMS. YOU ACKNOWLEDGE AND AGREE THAT IN THE EVENT GEM MATCHMAKING CONDUCTS A CRIMINAL RECORDS SCREENING ON YOU, GEM MATCHMAKING WILL HAVE NO OBLIGATION TO PROVIDE YOU WITH A COPY OF SUCH SCREENING OR ANY OTHER SCREENING MATERIALS OR ANY OTHER INFORMATION RELATED TO IT AND GEM MATCHMAKING RESERVES THE RIGHT TO MAKE CHANGES TO YOUR ACCOUNT, INCLUDING BUT NOT LIMITED TO REVOKING ACCESS TO THE SERVICE OR TERMINATING YOUR ACCOUNT BASED ON THE RESULTS OF SUCH CRIMINAL RECORDS SCREENING. CUSTOMER AGREES, AND GEM MATCHMAKING REPRESENTS, AND WARRANTS, THAT GEM MATCHMAKING IS NOT A “CONSUMER REPORTING AGENCY” AS DEFINED UNDER THE UNITED STATES FAIR CREDIT REPORTING ACT (FCRA), TITLE 15 SECTION 1681(f), AND THAT ANY PUBLIC RECORDS THEY RETRIEVE, COMPILE, AND PROVIDE ARE NOT A “CONSUMER REPORT” AS DEFINED BY THE ACT UNDER TITLE 15 SECTION 1681(E), OF THE FCRA.

ONLY PUBLICLY AVAILABLE CONVICTIONS ARE INCLUDED IN THE SCREENING, AND NOT ALL CRIMINAL RECORDS ARE PUBLIC AND UP TO DATE IN ALL STATES. SCREENINGS DO NOT COVER OTHER TYPES OF CONVICTIONS OR ARRESTS FROM FOREIGN COUNTRIES. GEM MATCHMAKING DOES NOT CONDUCT FINANCIAL BACKGROUND CHECKS EXCEPT IN OPTIONAL LIMITED CIRCUMSTANCES AND TO THE EXTENT FOR VIP CLIENTS. YOU AGREE THAT IT IS YOUR RESPONSIBILITY TO TAKE REASONABLE PRECAUTIONS IN ALL ACTIONS AND INTERACTIONS WITH OTHER USERS OF THE SERVICES; THIS IS ESPECIALLY IMPORTANT IF YOU DECIDE TO MEET WITH OTHER USERS IN PERSON. IN ABSOLUTELY NO EVENT SHALL GEM MATCHMAKING BE HELD LIABLE FOR ANY DAMAGES, IN ANY FORM, ARISING OUT OF OR RELATING TO YOUR OR ANYONE ELSE’S CONDUCT IN CONNECTION WITH THE USE OF THE SERVICES. THIS INCLUDES, WITHOUT LIMITATION, THAT WE WILL NOT BE HELD LIABLE FOR ANY MENTAL INSTABILITY, EMOTIONAL DISTRESS, FINANCIAL DISTRESS, OR BODILY INJURY, WHETHER INDIRECT, DIRECT, INCIDENTAL, OR ACCIDENTAL, ARISING OUT OF OR RELATING TO YOUR OR ANYONE ELSE’S CONDUCT IN CONNECTION WITH THE SERVICES

Purchase and payment options: Gem Matchmaking offers five levels of Client Service Packages based on desired assistance. All Package Types are subject to Gem Matchmaking's Cancellation & Refund Policy. All customers must pay the full Start-Up fee to begin the Pre-Approval process. Once a membership is approved, pre-paid add-on services are offered individually for a flat fee and sometimes part of a promotional price. You may purchase the Start-Up fee using a credit or debit card, Zelle, or Apple Pay. You hereby authorize and consent to Gem Matchmaking using your payment method without an original signature to purchase the Services. Memberships are purchased as monthly subscriptions via credit card. You agree that Gem Matchmaking may process your credit card automatically for any balance owed upon the designated due date and without additional notice.

Match Searching: A Gem Matchmaker searches profiles in Gem Matchmaking’s confidential database and other resources to identify potentially suitable singles, then screens each to better understand whether the Member’s Search Criteria may be attributable to the potential Match. The Matchmaker’s Search will include an area of up to 30 geographical miles in radius from Annapolis, MD, 21401, and search according to a ten-year age range close to your age, and subject to Gem Matchmaking’s maximum age difference of 20 years.

Match Screening: Gem Matchmaking does not screen for multiple-partner or alternative relationship preferences, nor do they screen for sexual preferences beyond gender and sexual orientation. We believe alternative relationship preferences and sexual inclinations, practices, and pursuits are best left for an intimate discussion between two people intent upon entering a relationship when the time is right. We also do not screen for highly particularized body dimensions or measurements beyond a general height range and body type. The Matchmaker will search for singles who exhibit characteristics within your preferred body types, but we can’t guarantee body type matching. Gem Matchmaking does not screen for preferences related to personality tests/analysis, astrological signs, animal signs, ceremonial or divinatory practices, or other characteristics outside our proprietary Matching methodology. We also do not screen for particular types of education beyond the level of degree earned or "professions" beyond general categories such as "professional" and/or employment status.

Match Presenting: Upon selecting the Match, Gem Matchmaking will describe the Match, known as the "Match Presentation," and how it aligns with the Client’s Search Criteria. Gem Matchmaking will provide approved profile photographs and videos if the Client is interested in the Match. We ask you to acknowledge the time and effort Gem Matchmaking puts into searching, Screening, and presenting a potential Match by not unreasonably withholding or delaying consent to the match based on these parameters. We ask that you consent to the Match during the Match Presentation. Choosing a candidate is naturally a collaborative and iterative process; however, Gem Matchmaking will decide, at its sole discretion, whether a candidate who reasonably reflects a client’s search criteria is a suitable match. If you unreasonably withhold consent to a Match that is in alignment with your Search Criteria or a reasonable combination thereof, you will forfeit the Match. This means you will lose the match and the benefit and value of all of the matchmaker’s work and discernment when selecting this candidate for you.

CANCELATION AND REFUND POLICY

This Gem Matchmaking, Cancellation & Refund Policy is a contract between Gem Matchmaking, Inc. ("we," "us," "our," or "Gem Matchmaking") and its customers ("you," "your," “Member,” “Members”). It describes Gem Matchmaking’s Cancellation and Refund Policies regarding the Matchmaking Services it provides via the Service Agreement. This Cancellation and Refund Policy applies to you when you purchase Services from Gem Matchmaking, which is entered into as of the date you are bound to our Service Agreement and is governed by our Service Agreement.

This Cancellation and Refund Policy is subject to change at our discretion. Any such changes will become effective upon notification, which we may effect by sending you notice by email. Your use of the Services after such notice constitutes your acceptance of the changes. You agree to periodically review the Cancellation and Refund Policy to be aware of such revisions. Terms not otherwise defined herein have the meanings ascribed to them in the Service Agreement.

DATE CANCELATION

We have created a date cancellation policy to maintain a respectful community of Members. Members risk being suspended if they cancel more than two scheduled Dates without at least 24 hours notice or do not attend them altogether. We understand that things come up, and schedules will change. Our goal is to work with our members as best we can but also be mindful of the matchmaking experience we provide. We ask that you notify your matchmaker directly if you must cancel more than two dates without 24 hours ’ notice. Members who do not follow this policy will be suspended. The assigned Matchmaker will investigate to determine if the policy wasn’t followed.

CANCELATION AND REFUND POLICIES GENERALLY

If you are selected as a Gem Matchmaking Member (OUR SERVICES described in the Service Agreement), all purchases from Gem Matchmaking are FINAL. You acknowledge and agree that Gem Matchmaking has already commenced preparing for and performing the Services as of the date of your selection as a Member.

REFUND POLICY

All purchased services are non-refundable.

OTHER REMEDIES

Although a Refund may not be available, other remedies may be available to you by the below and subject to Gem Matchmaking's discretion.

PAUSING YOUR MEMBERSHIP:

You may Pause your membership for circumstances like exploring a promising relationship, accommodating travel and vacations, or scheduling conflicts up to two times per year. You must pause your monthly subscription; this is not done automatically. Additional requests to pause your subscription must be submitted in writing and sent to support@gemmatchmaking.com; otherwise, renewing your subscription might not be honored. Accounts paused for over two consecutive years will automatically be closed. Members may request to reopen their account in writing at support@gemmatchmaking.com. Account reopening requests are subject to review and approval from a Gem Matchmaking Matchmaker.

CANCELING YOUR MEMBERSHIP:

If you cancel your membership, you may use it until the end of the period you last paid for, but (i) you will not be eligible for a prorated or full refund, and (ii) your subscription will not be renewed when that period expires. Canceling your membership does not remove your profile from our Services. If you wish to terminate your account entirely, you must submit a written request using a required form under Canceling Subscriptions and send it to support@gemmatchmaking.com.

CHANGING YOUR MEMBERSHIP: Members can upgrade or downgrade their memberships anytime. The new membership level will take effect the following month. Any unused and prepaid services, such as Date Planning, Date Feedback, or Wardrobe Styling sessions, can be carried over to the new membership plan.

CANCELATION FOR SUCCESSFUL MATCHING: Under this Cancellation and Refund Policy, "Successful Matching" is defined as an introduction to a person via a Gem Matchmaker with whom you have commenced an exclusive Romantic Relationship (as described in the Service Agreement.) Documentation Required for Successful Matching: To cancel or pause your membership, you must submit a form of documentation verifying the Match and make it available for possible marketing use and publication by Gem Matchmaking. Some examples of such documentation may include one or all of the following: a testimonial regarding your Gem Matchmaking experience and the successful Match; a brief video recounting the story of the Match; a photo shoot celebrating the Match; a social media review of your Gem Matchmaking experience confirming the Match; an anonymized success story. In all cases, an express confirmation from your Match authenticating the success of the Match, as defined above, will be required.

DISCOVERY MEETING CONSULTATIONS AND DEPOSITS

Gem Matchmaking offers a one-time in-person Discovery Meeting, which includes a social media review with a Matchmaker at all membership levels. During this meeting, we will gain insight into your dating needs and determine which service package is right for you. Any fees associated with the Discovery meetings must be paid before attending and are non-refundable and non-transferable.

CRIMINAL BACKGROUND CHECKS

Completing a criminal background investigation is part of the qualification process for becoming a Member of Gem Matchmaking. Members acknowledge that no refunds are issued once the background investigation is requested.

SINGLES EVENTS

All members of Gem Matchmaking are permitted to attend member and non-member singles events. Depending on the event venue, a purchased ticket is not guaranteed to be refunded. Please refer to every event’s refund policy.

NO REFUNDS OR GUARANTEES

NO REFUNDS: Gem Matchmaking does not offer refunds for paid services. However, we value our Members and their business and will work with a dissatisfied Member to find a solution. Members can cancel their membership at any time but must take appropriate action to terminate or disable their account if they are dissatisfied with the service under Changing and Canceling Subscriptions and Auto-Renewal.

NO GUARANTEES: We strive to provide our customers the opportunity for Relationship Success; however, there are no guarantees. Given the complexity of human nature, the challenges of interpersonal relations, and other constraints, we do not provide any warranty that our Services will result in a specific timeline, general Occurrence of Dating and communications with your Matchmaker that you will find that special person using Gem Matchmaking Services, or that you will be satisfied. You agree that when you go on a Date and attend member and non-member events, we cannot control how you, our Members, and non-members behave or discern anyone’s veracity or true intentions for participating in the Service or Event. If that first meeting or Date leads to a second date or Romantic Relationship, we cannot control how the continued relationship unfolds and where it may lead. Although we strive to provide matches frequently, the occurrences of available matches are impacted by geographic constraints, the number of available singles, your chosen search criteria, your willingness to adjust the search according to input from your matchmaker, and other factors that may affect the search. The rate at which we can produce Matches will differ and, in some cases, be very quickly and often, and in other instances, be slower and less frequent. You agree that Match Occurrence may vary, and any statements made by Gem Matchmaking regarding such are for general benchmark purposes only. Gem Matchmaking does not warrant and is not responsible for the actions, words, or conduct of any Member of our Services or non-member. We are not responsible for any errors or delays in communications between Members and non-members. We are not responsible for the Content of messages or in-person communications and interactions between Members and non-members. We are also not responsible for unauthorized access to our Members' accounts. Gem Matchmaking is not responsible for any damage to Members or non-members, including but not limited to loss, damage, emotional distress, personal injury, theft, or death resulting from anyone's use of the Services. We are not responsible for any technical malfunction, failure, or damage to your computer due to using or visiting the Services.

RESCHEDULING AND CANCELATION OF SERVICES

Gem Matchmaking caters to singles who are serious about finding love and a lasting relationship. Regular attendance in meetings and sessions is required to serve our members best. However, we understand that life happens and schedules change. All Members must provide at least 24 hours of notice to cancel, schedule, or reschedule a first date arranged by a Gem Matchmaking matchmaker, Discovery Meeting, or wardrobe styling session. Members must give at least 24 hours' notice to cancel a post-date and post-event feedback session. The penalty for members who do not repeatedly follow this policy may result in suspension or termination of the membership. Members are encouraged to use a calendar to track the scheduled events described above. A Gem Matchmaker will investigate and determine if Membership suspension or termination is necessary if a Member is reported by another Member(s) as frequently rescheduling and canceling dates.

PRICING TERMS

Gem Matchmaking’s pricing varies by several factors. We might offer promotional rates - which can vary based on the length and the type of subscription. We could also test new features and payment options. Gem Matchmaking reserves the right, including without prior notice, to limit the available quantity of or discontinue making available any product, feature, service, or another offering; to impose conditions on the honoring of any coupon, discount, offer, or other promotion; to bar any user from making any transaction; and to refuse to provide any user with any product, service or other offering or to honor any offer.

Free Trials: Gem Matchmaking will notify members when a free trial ends and offer options for continuing their membership. Once your free trial converts to a subscription, your subscription will renew automatically at the end of each period, and your Payment Method will be charged until you cancel. To avoid charges for a new subscription period, you must cancel before the end of the then-current subscription period or free trial period as described above. Deleting your account from your device does not cancel your free trial.

In the event of a price change, we will notify you in advance by sending an email and other communication message using the contact information you have registered for your account. If you do not wish to accept a price change for a renewed subscription, you may cancel your subscription by following the instructions in that communication and below. Suppose you do not cancel your subscription promptly. In that case, your subscription will be renewed at the price in effect at the time of the renewal, without any additional action by you, and you authorize us to charge your payment method for these amounts. To the extent permissible by law, we reserve the right, including without prior notice, to limit the available quantity of or discontinue making available any product, feature, service, or another offering; to impose conditions on the honoring of any coupon, discount, offer or other promotion; to bar any user from making any Transaction; and to refuse to provide any user with any product, service or other offering.

RIGHT TO TERMINATE AND TERMINATION BASED ON PARTICIPATION/CONDUCT/RELOCATION

We do not often experience collaboration challenges with our Members and certainly do not anticipate we will in your case. Still, we do reserve the right to terminate any Membership, at any stage of the experience, without Refund if you: (1) you consistently or repeatedly refuse an introduction to selected Matches or fail to participate in the Services without notice to Gem Matchmaking; (2) you exhibit a problematic or repeated lack of availability to either the Matchmaker or to your Matches; (3) Matches report to us that you behaved poorly before, during, or after the date; (4) you provided false or misleading information to either us or to selected Matches; (5) you relocate to a geographical location in which Gem Matchmaking is unable to provide you the services; (6) you exhibit inappropriate behavior toward our staff or Members of our community; (7) or you violate any of the terms of your Agreements. ARBITRATION

If a dispute arises out of or relates to this contract or the breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration, litigation, or some other dispute resolution procedure.

SAFETY PRACTICES

We want your dating life to be safe and sound during Gem Matchmaking, outside dates, and member and non-member events. We share these best practices for you to remember in all your dating experiences. If you are in immediate danger, please call 911 or your local emergency services number. Suppose you’ve had a bad experience with a match or member of Gem Matchmaking or an attendee at a member and non-member event with which Gem Matchmaking is affiliated. In that case, we encourage you to report those incidents or individuals at support@gemmatchmaking.com so we can further investigate and take action. Gem Matchmaking is affiliated with dating services such as Baltimore Singles, Meet My Friend. We encourage you to report other matchmaking or dating services that claim to be affiliated with our service to support@gemmatchmaking.com.

SAFETY

Though Gem Matchmaking strives to encourage a respectful user experience, it is not responsible for the conduct of any user on or off the Service. You agree to use caution in all interactions with other users, particularly if you decide to communicate off the Service or meet in person. Members are solely responsible for their interactions with other Members and non-members. Your use of our Service is at your own risk. Please review the "SafetyPractices" for more details regarding trust and safety protocols and our disclaimers. We do not tolerate discrimination toward our Members, Customers, contractors, associates, and employees. This includes hateful, offensive, disparaging, harassing, threatening, abusive, assaultive, defamatory, and harmful conduct or language that intentionally or inadvertently targets any individuals, groups, communities, affiliations, religions, and associations. Gem Matchmaking prohibits any scam or theft activity intended to defraud or manipulate members out of financial or material resources. This includes requesting or seeking financial support, lying about your intentions for monetary gain, or faking romantic intentions to deceive members. We don’t allow content or behavior that makes any individual or group feel harassed, bullied, or targeted. This includes derogatory, insulting, or intimidating behavior; making unsolicited comments about someone’s appearance; engaging in emotional abuse; blackmail; repeated unwanted contact; or wishing, encouraging, or praising acts of violence. We don’t tolerate any behavior that commits or threatens credible acts of physical or sexual violence. This includes physical stalking, facilitating or supporting exploitation or human trafficking, and sexual assault of any kind, which we define as unwanted physical contact or attempted physical contact that is sexual, cyber-flashing (i.e., sharing unsolicited sexually explicit images), in-person indecent exposure, sharing or threatening to share sexual or intimate images without the consent of the person involved or depicted, sending unwanted sexual comments or photos, and fetishization.

SAFETY REPORTING

Our members play a critical role in the safety of Gem Matchmaking by reporting content or behavior that may violate our guidelines. If anything happens that makes you feel uncomfortable or unsafe, we highly encourage you to report the member. However, please consider that disagreeing with or disliking a member is not necessarily a reason to report them. We may take action against a member if we’ve found them intentionally creating false or inappropriate reports against other members solely based on their protected attributes. This includes reporting transgender or nonbinary members for no reason other than their gender identity or expression or repeatedly sending false reports of bad behavior.

Please immediately report to us anyone who violates our Terms of Use. Here are some examples of violations:

Requesting money
Underage users
Sending harassing, threatening, or offensive messages
Misbehaving during or after a date
Creating fraudulent profiles
Spamming or soliciting, including providing links to commercial websites or attempting to sell products or services
SAFE DATING
Gem Matchmaking matchmakers are experts at coordinating first dates that allow you to have fun and explore chemistry while prioritizing your safety and well-being. Your matchmaker will never orchestrate a date in a non-public or remote location. If your match or date pressures you to change locations to an isolated place or prematurely move the date to their house, end the date, and leave. Let your matchmaker know.
E-mail or text with caution and only after confident in your knowledge of someone.
Until you get to know someone, insist on communicating via the Services and do not exchange your personal contact information.
You know your limits with drug and alcohol consumption better than anyone. Do not let your match, date, or anyone else pressure you into anything you’re uncomfortable with. If someone tries to pressure you to use drugs or drink more than you’re comfortable with, end the date.
Never leave drinks or personal items unattended.
Drive yourself or use a ride-share app to get to and from your date's location so you can leave when you want to.
Tell a friend or family member about your date plans, including when and where you’re going, who you're going with, and when you expect to return. If anything changes during the evening, let them know right away.
Carry your fully charged cell phone with you at all times
Consider sharing your location with a friend or family member via the location-sharing tool on your smart device.
Be mindful of the life details you reveal on a first date. Don’t reveal family members’ names, places you frequently visit, or your birth date. It’s okay to take it slow.

When used correctly and consistently, condoms and other protection can reduce the risk of contracting or passing on an STD, such as HIV. However, it is possible to get certain STDs, like herpes or HPV, from contact with your partner's skin, even when using protection.
All sexual activity must start with consent. Verbal communication can help you and your partner ensure that you respect each other’s boundaries. Remember that consent can be withdrawn at any time. Never proceed if your partner is unsure or if they are unable to consent due to alcohol or drugs.

As a member of Gem Matchmaking, the photographs of my image in my member profile may be shared with other Gem Matchmaking members.
I will not receive any special compensation for allowing my image to be photographed or video recorded at Gem Matchmaking and affiliated events.
Gem Matchmaking holds all intellectual property rights to any photographs and video recordings of my image. It may be edited, altered, and used for various purposes, including social media, email communications, the Gem Matchmaking website, and Gem Matchmaking and affiliated event marketing.
I can opt out of having my image photographed or video recorded at Gem Matchmaking and affiliated events.
I can choose not to have my photographed or video-recorded image and/or voice recordings used for testimonial and/or marketing purposes related to Gem Matchmaking.
